Definitions

Credit Card Online Payment Facility means the facility provided through the Crombie Lockwood Websites, operated by a third party, for the purpose of processing credit card payments online.

Crombie Lockwood means Crombie Lockwood (NZ) Limited and its affiliates or subsidiaries including Monument Insurance (NZ) Limited and Offshore Market Placement Limited.

Crombie Lockwood Website means any website included in the network of websites controlled by Crombie Lockwood and to which these Terms of Use and the Privacy Policy are linked.

Insurance Services means the insurance brokerage services provided by Crombie Lockwood.

Liability means any direct or indirect loss, damage, cost, charge, claim, demand, expense, judgment, action, proceeding or other liability whatsoever (including, without limitation in respect of taxes, duties, levies, imposts, penalties and other charges) whether in contract, tort (including negligence), statute or otherwise.

Marks means trademarks, service marks, and trade names.

Online Purchase Facility means the facility provided on the Crombie Lockwood Websites for the purpose of providing quotations for and selling insurance policies offered by certain insurers.

Personal Information means the information about an individual which identifies or is capable of identifying that individual, including but not limited to, names, addresses, email and other contacts, employment, claims, or criminal history.

Privacy Policy means the privacy policy that is linked to the Crombie Lockwood Websites, and which governs the use of Personal Information collected via the Crombie Lockwood Websites.

Terms of Use means these terms of use which are linked to the Crombie Lockwood Websites and which govern use of the Crombie Lockwood Websites.

In these Terms of Use, unless the context otherwise requires:

  • the singular includes the plural and vice versa;

If you choose to use the Credit Card Online Payment Facility accessed through the Crombie Lockwood Websites, you may be subject to additional terms and conditions imposed by the third party provider of that Credit Card Online Payment Facility.  Any use by you of that facility is at your own risk, and Crombie Lockwood does not accept any Liability in relation to that facility.  If you do not wish to pay using the Credit Card Online Payment Facility you can contact Crombie Lockwood to arrange alternative payment methods.

While Crombie Lockwood will use reasonable endeavours to ensure that the content and material on the Crombie Lockwood Websites is free from error, Crombie Lockwood does not warrant (and has no Liability for) the accuracy, adequacy or completeness of the content and material on the Crombie Lockwood Websites or that the content and material on the Crombie Lockwood Websites is suitable for your intended use.

If any of these Terms of Use shall be deemed invalid, void or for any reason unenforceable, that term shall be deemed severable and shall not affect the validity and enforceability of any remaining terms.

Crombie Lockwood holds the copyright to the Crombie Lockwood Websites. Crombie Lockwood grants you a limited licence to access and copy the Crombie Lockwood Websites for personal use only. You are not permitted to make any copy of any content of the Crombie Lockwood Website (other than for your personal use consistent with the Terms of Use), or reproduce (in any form) or alter the Crombie Lockwood Websites for any purpose, without the prior written consent of Crombie Lockwood.

All Marks are proprietary to Crombie Lockwood, or other respective owners that have granted Crombie Lockwood the right and license to use such Marks.
